Terms of Service

1. Agreement

These Terms of Service govern your use of ThanksMom (tma.mom), a product of The Hammurabi Coding Company, Eau Claire, Wisconsin, USA, developed by R.K. Girdhari [HAMMURABI]. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

2. Description of Service

ThanksMom is a free family organization platform that provides task management, calendar scheduling, communication tools, file sharing, rewards gamification, and guidance resources. The Service is designed to help families stay organized, connected, and grateful. ThanksMom is provided as a Progressive Web Application (PWA) accessible through web browsers on any device.

3. User Accounts

3.1 Registration

To use certain features of the Service, you must create an account through Manus OAuth authentication. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Deletion

You may delete your account at any time through the Profile settings page. Upon deletion, your personal data will be removed within 30 days. Content you shared within family groups may remain visible to other group members.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Infringe on the rights of others, including intellectual property rights
  • Upload or transmit viruses, malware, or other malicious code
  • Harass, abuse, or harm another person or group
  • Send spam, unsolicited messages, or automated requests
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers
  • Impersonate any person or entity
  • Collect or store personal data about other users without their consent

5. User Content

5.1 Ownership

You retain ownership of all content you create, upload, or share through the Service ("User Content"), including tasks, events, messages, files, and profile information.

5.2 License

By uploading User Content, you grant ThanksMom a limited, non-exclusive license to store, display, and transmit your content solely for the purpose of providing the Service to you and your family group members.

5.3 Responsibility

You are solely responsible for your User Content. You represent that you have all rights necessary to upload and share your content, and that your content does not violate any third-party rights.

6. Family Groups

ThanksMom allows you to create and join family groups. Within these groups:

  • Group administrators can manage members, assign roles, and configure group settings
  • Content shared within a group is visible to all members based on their assigned role and permissions
  • Removing a member from a group does not automatically delete their previously shared content
  • Group administrators are responsible for managing their group's membership and content

7. Pricing

ThanksMom is currently provided free of charge. We reserve the right to introduce premium features or paid plans in the future. If we do, existing free features will remain available, and we will provide advance notice of any changes to pricing or feature availability.

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of The Hammurabi Coding Company and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. We do not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, or that any defects or errors will be corrected.

10. Limitation of Liability

In no event shall The Hammurabi Coding Company, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

11. Indemnification

You agree to defend, indemnify, and hold harmless The Hammurabi Coding Company and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time by using the account deletion feature in your Profile settings.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Wisconsin and the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms.
